ERISA Disability Benefits Denied

A Federal District Court Judge in Alexandria has ruled in favor of Hartford Life Insurance Company on a claim brought under a long-term disability policy that it issued. ERISA governed this long term disability benefits claim. Even though the claimant was receiving Social Security Disability Benefits the court found that the claimant had not proven that he is disabled from working in any occupation. The court found it persuasive that the claimant’s primary treating physician for his back problems, and the only physician who had ever placed restrictions on claimant’s ability to work, agreed that the claimant was capable of working in a light occupation. The insurance company also produced two independent medical reviews that supported the denial of the claim.
