MEDICAL MALPRACTICE STATUTE OF LIMITATIONS: How long do I have to file a medical malpractice lawsuit against my doctor? Its been nearly two years since I first became ill, but my doctor misdiagnosed my condition and has been treating me ever since.
A: In Virginia, you have 2 years from the date of the injury to sue your doctor for damages, which is known as the statute of limitations. However, this 2-year period can be extended based on the continuing treatment rule. According to this rule, the statute of limitations does not start until the doctor who caused your injury is no longer treating you.
