CONTINGENCY FEES: I talked to a personal injury attorney who I saw advertised on TV. I was in an accident where the defendant rear-ended me. The attorney wanted to charge me a contingent fee of 40% of the recovery. Is this normal?
A: In my view, a contingent fee of 40% in a car accident case is ridiculously high. It's no wonder lawyers get a bad reputation. Most attorneys will charge somewhere in the range of 33.33% of the recovery for settlement of a personal injury case.
We actually do something a little different. Our contingent fee is 25% of the recovery if your case is settled before suit is filed. No, we don't compete on price but we do believe that 25% for a car accident case that is settled before a suit is filed is reasonable.
We are very selective about the cases we accept and not all cases qualify for representation by Ben Glass.
