MISDIAGNOSIS AND MEDICAL MALPRACTICE: My mother was admitted to the hospital in January 2009 for a week, because she had swollen legs. Several tests were done, including a chest x-ray, and she was diagnosed with chronic obstructive pulmonary disease (COPD). Two months later, she was in the hospital again due to dehydration. The doctor diagnosed her with stage 4 lung cancer and she died within a month. Do I have a medical malpractice case?
A: When a medical provider misdiagnoses or delays diagnosis of cancer or another serious condition, it could lead to a Virginia medical malpractice claim.
