MISDIAGNOSIS AND MEDICAL MALPRACTICE: My mother was admitted to the hospital in January 2009 for a week, because she had swollen legs. Several tests were done, including a chest x-ray, and she was diagnosed with chronic obstructive pulmonary disease (COPD). Two months later, she was in the hospital again due to dehydration. The doctor diagnosed her with stage 4 lung cancer and she died within a month. Do I have a medical malpractice case?

A: When a medical provider misdiagnoses or delays diagnosis of cancer or another serious condition, it could lead to a Virginia medical malpractice claim.  To have a medical negligence case, you need to show that the doctor or hospital’s actions deviated so far from what is the accepted standard within the medical field that they would be considered negligent.

You can read more about medical malpractice lawsuits in my book, Why Most Medical Malpractice Victims Never Recover a Dime.

Most Virginia medical malpractice attorneys offer free consultations, so it would be wise to have someone review the full details of your case.
