Q: Should I be seen by my MD for reassessment of the condition to avoid potential problems from my ERISA insurer? If so, how do I approach my doctor?

A: Yes, the insurance company will periodically request medical records from your doctor so it is appropriate for you to approach your doctor for a reassessment of your condition.  Generally the direct approach is the appropriate approach.  Tell your doctor that you are still on claim and that you would like to be reassessed for disability purposes.  Understand, however, that your condition may have improved (that's good news) and thus this reassessment may lead to a termination of benefits.
