Frequently Asked Questions about Personal Injury, Medical Malpractice, and Insurance Disputes

Q: I just starting receiving LTD payments, by way of my bank, and my bank is trying to take the money to pay a charged-off loan.  Is this legal?

A: What may be happening is that a judgment has been rendered against you and the judgment creditor has garnished your account at the bank.  Thus any money going into the account is subject to the garnishment of the creditor.  Yes, this is legal.  You might consider directing your long-term disability insurance company to send you the check instead.  You should then open a different bank account at a different bank.
