Frequently Asked Questions about Personal Injury, Medical Malpractice, and Insurance Disputes

Q: I just found out from my disability claim reviewer that I should be receiving 60% of my pay instead of the 40% that I am currently receiving.  I am currently receiving Social Security Disability as well.  The numbers that they are quoting me don’t seem right and I am afraid that they will come after me in the future to get their money back.  What should I do?

A: Whenever there is a discrepancy between you and your long-term disability insurance company over the amount of money that you are receiving you should have your contract and your payments reviewed by an experienced long-term disability insurance attorney.  We have seen cases where the insurance company has miscalculated the amount due and then come back, years later, and attempted to recover the "overpayment."  That can cause extreme financial hardship.  It is much better to get this right early and consulting with an experienced disability insurance company attorney now can help assure that the payments are correct.
