Q: Is there a statute of limitation on a malpractice suit?  How long after a malpractice injury do you have legal claim?

A: The general medical malpractice statue of limitations in Virginia is two years from the date of the malpractice. The time may be longer if the defendant continued to treat you in follow up or if the malpractice involves a retained foreign object (i.e. a sponge). You should always consult with an experienced attorney to talk about the statute of limitations for your case.
