Q: I was just approved for Social Security Disability. It took a year, so I will receive a lump sum payment for back benefits. Up until now, Unum paid benefits to me through my former employer's disability policy. Do I have to repay those benefits to Unum or my employer?
A: Most LTD policies require that the benefits provided by the insurance company be offset by any SSD income. That means that you will have to pay those benefits back to whoever provided them. Also, your monthly SSD benefit will offset by however much from your monthly benefit from the insurer. So getting SSD means the same amount of money for you, just less of it coming from the insurer's pocket. No wonder the insurance company hires lawyers to help you get SSD.
