TYPES OF ATTORNEYS: What is the difference between a personal injury attorney and a medical malpractice attorney ?

 

A: A medical malpractice attorney is a subset of personal injury attorney. In other words, they are both dealing with claims arising out of injury because of someone's carelessness. The difference is that one defendant ran a red light and one defendant breached a medical standard of care.

All medical malpractice attorneys can handle serious personal injury cases but not all personal injury attorneys (or attorneys who ADVERTISE that they handle personal injury cases) have the knowledge and experience to handle medical malpractice cases.

Medical malpractice cases are generally much more complicated than most personal injury cases.

Medical malpractice attorney will generally have access to good experts; experience with Virginia's tricky statutes of limitations for malpractice cases; knowledge of Virginia's expert certification experience and, most importantly, experience going to trial in Virginia in a medical malpractice case.
