  • Problems from colonoscopy in Virginia Malpractice Case
    It was error for the trial court to receive into evidence in a Virginia medical malpractice trial involving complications from colonoscopy certain general statistical information related to the frequency of problems relating to diagnostic and surgical excision procedures. The judgment is reversed and the case is remanded.
  • Sexual assault at nursing home not covered by malpractice act
    Causes of action for negligence as well as sexual assault and battery based on the failure of nursing home personnel to ensure a resident's safety are not subject to the provisions of the Medical Malpractice Act, Code § 8.01-581.1 through -581.20:1, because such claims are not “based on health care or professional services rendered, or which should have been rendered,” within the meaning of the Act. The circuit court's contrary judgment is reversed and the case is remanded for further proceedings.

    The plaintiff patient scheduled and gave written consent for both a hysterectomy and a bilateral salpingo oophorectomy. The defendant performed the hysterectomy but forgot to perform the oopherectomy, which required plaintiff to undergo a subsequent surgery and incur damages attendant thereto. In this medical malpractice action, plaintiff presented an expert witness who testified about the relevant standard of care for a doctor engaged in this field of practice.
  • Expert Who had Not Performed Procedure Disqualified
    Plaintiff sued the defendant orthopaedic surgeon and his practice group for medical malpractice in the performance of a surgical procedure upon him known as an anterior cervical discectomy decompression and for his post-operative treatment in the hospital. Plaintiff alleged that the surgeon should not have cut plaintiff's spinal cord during the surgery so as to leave him partially paralyzed, and should have administered certain medicine to him within the first eight hours after the surgery to minimize and/or correct the spinal cord injury.

    In two separate but identical wrongful birth lawsuits by the mother and father of twin daughters afflicted with Down syndrome, these plaintiffs alleged that the defendant physicians undertook to provide obstetrical services and prenatal care to the couple, thereby establishing a physician-patient relationship with both parents, and that defendants breached the standard of care by failing to provide the mother with information about first trimester testing known as chorionic villus sampling, which would have revealed that her twin fetuses were afflicted with Down syndrome.

    In a medical wrongful death action, because the evidence clearly demonstrated that a proffered medical expert witness met the statutory “knowledge” and “active clinical practice” requirements under Code § 8.01-581.20 to testify with regard to the medical procedure at issue, the circuit court's judgment dismissing the case with prejudice after finding that the expert could not testify is reversed and the case is remanded for further proceedings.
