Court Opinions Medical Malpractice

  • Sexual assault at nursing home not covered by malpractice act
Causes of action for negligence as well as sexual assault and battery based on the failure of nursing home personnel to ensure a resident's safety are not subject to the provisions of the Medical Malpractice Act, Code § 8.01-581.1 through -581.20:1, because such claims are not “based on health care or professional services rendered, or which should have been rendered,” within the meaning of the Act. The circuit court's contrary judgment is reversed and the case is remanded for further proceedings.
  • Attorney failed to object to testimony
In a medical malpractice action, although plaintiff's only medical expert witness did not state his opinion to a reasonable degree of medical probability, defendant did not make a contemporaneous objection thereto and defendant's motion to strike the expert's testimony, made at the close of plaintiff's evidence, was not timely.
  • Hospital required to produce internal rules in failure to take precautions against fall case
In a personal injury suit brought against a hospital and its nurse by a decedent's executor, alleging failure to take proper precautions against falls by an elderly patient
  • Problems from colonoscopy in Virginia Malpractice Case
It was error for the trial court to receive into evidence in a Virginia medical malpractice trial involving complications from colonoscopy certain general statistical information related to the frequency of problems relating to diagnostic and surgical excision procedures. The judgment is reversed and the case is remanded.
  • Doctor Forgets To Do One Part of Operation
The plaintiff patient scheduled and gave written consent for both a hysterectomy and a bilateral salpingo oophorectomy. The defendant performed the hysterectomy but forgot to perform the oopherectomy, which required plaintiff to undergo a subsequent surgery and incur damages attendant thereto. In this medical malpractice action, plaintiff presented an expert witness who testified about the relevant standard of care for a doctor engaged in this field of practice.
  • Expert Who had Not Performed Procedure Disqualified
Plaintiff sued the defendant orthopaedic surgeon and his practice group for medical malpractice in the performance of a surgical procedure upon him known as an anterior cervical discectomy decompression and for his post-operative treatment in the hospital. Plaintiff alleged that the surgeon should not have cut plaintiff's spinal cord during the surgery so as to leave him partially paralyzed, and should have administered certain medicine to him within the first eight hours after the surgery to minimize and/or correct the spinal cord injury.
  • Doctor Wins "Wrongful Birth" Case Appeal
In two separate but identical wrongful birth lawsuits by the mother and father of twin daughters afflicted with Down syndrome, these plaintiffs alleged that the defendant physicians undertook to provide obstetrical services and prenatal care to the couple, thereby establishing a physician-patient relationship with both parents, and that defendants breached the standard of care by failing to provide the mother with information about first trimester testing known as chorionic villus sampling, which would have revealed that her twin fetuses were afflicted with Down syndrome.
  • Doctor Can't Point at Next Doctor and Say "His Fault, Not Mine""
This case blunts the somewhat common defense by Virginia doctors that "well, I may have been negligent but the doctor who treated the patient after me was more negligent."
  • Supreme Court says that medical malpractice expert was qualified to testify and case should not have been thrown out.
In a medical wrongful death action, because the evidence clearly demonstrated that a proffered medical expert witness met the statutory “knowledge” and “active clinical practice” requirements under Code § 8.01-581.20 to testify with regard to the medical procedure at issue, the circuit court's judgment dismissing the case with prejudice after finding that the expert could not testify is reversed and the case is remanded for further proceedings.
  • Survival Action or Wrongful Death In Virginia
In a medical malpractice action, the circuit court did not err in refusing to require the administrators of a decedent's estate to elect between alternative claims for wrongful death and a survival action for personal injuries to the decedent, both of which allegedly arose from the same acts of medical negligence. Election between these remedies was required only at a time when the record sufficiently established that the personal injuries and the death arose from the same cause.
  • Not all Virginia Medical Malpractice Cases Need Expert Testimony
In this Virginia medical malpractice case, where the doctor failed to perform one of two scheduled procedures, leading plaintiff to undergo a second surgical procedure, the plaintiff was not required to present expert testimony on the issue of causation. T
  • Virginia Medical Malpractice Victim Loses Trial and Appeal
In this wrongful death action, the sole issue we consider is whether the circuit court erred in denying a jury instruction proffered by the plaintiff. Because the instruction is not a correct statement of the law, as it removes a question of fact from the jury, we conclude the circuit court did not err in refusing to give the instruction. Thus, we will affirm the circuit court's judgment in favor of the defendants.

  • James v. Peyton, Virginia Supreme Court
In these consolidated interlocutory appeals arising from a personal injury action, we consider whether the circuit court erred in concluding that an amended motion for judgment properly names an administrator of an estate rather than the estate itself as a party defendant. Specifically, we consider whether the language “Estate of Robert Judson James, Administrator, Edwin F. Gentry, Esquire” names a proper party to the personal injury action in question in these appeals.

Workers Compensation

  • An Interview with Worker's Compensation Attorney Michele Lewane-The History
"I’ll start a couple hundred years ago or about a hundred years ago. In early century, during the industrial period, injured workers were getting seriously injured and so, what would happen is they would have to find fault with their employer and so, it would take years of litigation and then maybe they would win. So, each state started creating their own laws on workers’ comp that you give up, so the injured worker gives up those rights to get into what’s called a no-fault system which is called Workers’ Compensation, so they get a little bit of benefit supposedly right away."
  • An interview with Virginia Worker's Compensation Attorney Michele Lewane-the First Steps
"The first thing in a Virginia Worker's Compensation Case would be ideally to make sure there are some witnesses. Okay. One law is that you have to give your employer notice within 30 days of the accident; however, many employers have handouts that say they want notification within 24 hours and they’ll automatically deny you. You’ll eventually win through a long litigation process. So, the first thing is to immediately notify your employer. Another thing is to try to – and this is so hard when you’re – obviously you’re hurt and you don’t – you know, let’s say you slipped and fell at work, all right."
  • Virginia Worker's Compensation- When Do I Call the Lawyer?
"The ideal time to talk to an attorney in a Virginia Worker's Compensation case would be before that recorded statement, but a lot of times, people don’t think of workers’ comp as a – the thing that is like regular health insurance, they don’t think of it as an adversarial thing and that someone is going to try to trick them in their recorded statement because sometimes, you’re pretty much stuck with that, so the ideal time would be before that recorded statement."
