After you’ve been in a car accident, odds are you need to find the right answers to your questions soon. The good thing is you have the largest resource at your finger tips – the internet.
But I have some absolutely terrible news….you’re going to find a lot more “junk” out there than you need.
It seems that all the “experts”, be it insurance adjusters or other lawyers, will be feeding you false and misleading information. I’m writing this to help you sort through all the lies, and handle your case in a timely fashion. Some of the most common myths are with the insurance company.
Most people are under the impression that if you write the insurance company a letter and are reasonable, you will get a reasonable settlement proposal in return. If this were true, then the world would be a much better place, and so would the insurance adjustor.
Regardless of how “cool” your insurance agent may be, the insurance company is not your friend, which they may lead you to believe. What they consider to be a reasonable settlement is far less than what you’re most likely entitled to. Trust me, they’ll do their best to nickel and dime your settlement offer to try and get you to agree to the lowest possible amount.
Another situation you might run into is when the insurance adjustor pushes for you to make a recorded statement. This is NOT REQUIRED! If you run into this situation, tell the insurance adjustor you won’t until you speak with a Fairfax personal injury attorney.
Don’t let them bully you into a corner with this, having a recorded statement from you before you know what to, and not knowing what to say could have you shooting yourself in the foot. Things you say in the statement such as "Well, I may have stopped short when he hit me" can come back to haunt you, especially in Virginia where we follow contributory negligence laws. Don’t be your own worst enemy in your personal injury case, leave that to the insurance company.
