What is a reasonable fee for a car accident case in Virginia?

Recently we were contacted by a young woman who had gone to a "free consultation" by a TV advertising lawyer. The lawyer wanted her to sign a fee agreement at that first visit and he was charging a whopping 40% contingent fee.

A contingent fee means that the lawyer will not get paid unless there is a recovery. A 40% fee means that the first 40% of the recovery will go to the lawyer.

We think that's nuts. Or put another way "just way too darn high."

Most lawyers charge somewhere in the area of 33.33% for a Virginia car accident case. We actually do things a bit differently at BenGlassLaw.

While we do not compete on price and are very selective about who we will work with as a client, if we can get your car accident case settled before suit is filed, our fee is 25% of the recovery.

40%???

That's nuts.
