A mentally and physically disabled Northern Virginia man is appealing to the Virginia Supreme Court a Prince William County judge's decision to dismiss his personal-injury case against Didlake, Inc. Juan R. Jimenez, a 25-year-old man disabled since childhood, had alleged in his lawsuit that he was injured while receiving rehabilitative services at Didlake in April 2007. He claimed he suffered a femoral fracture which required surgery when he was moved by Didlake employees. On March 11, 2009, Circuit Court Judge Mary Grace O'Brien dismissed the lawsuit, ruling that Didlake was entitled to full immunity.

Virginia Medical Malpractice Victim Loses Trial and Appeal
In this wrongful death action, the sole issue we consider is whether the circuit court erred in denying a jury instruction proffered by the plaintiff. Because the instruction is not a correct statement of the law, as it removes a question of fact from the jury, we conclude the circuit court did not err in refusing to give the instruction. Thus, we will affirm the circuit court's judgment in favor of the defendants.

In these consolidated interlocutory appeals arising from a personal injury action, we consider whether the circuit court erred in concluding that an amended motion for judgment properly names an administrator of an estate rather than the estate itself as a party defendant. Specifically, we consider whether the language “Estate of Robert Judson James, Administrator, Edwin F. Gentry, Esquire” names a proper party to the personal injury action in question in these appeals.

Sometimes, though, it’s their professors and other administrators reinforcing this doom and gloom. One career-counseling official at a Virginia university was quoted as saying that her office was not very
busy these days because, it seemed to her, “students had just ‘given up.’” (Wonder what’s she’s doing to try to
reverse that thinking? Probably not much!)
