Manassas Virginia Motorcycle Accident Explained
Hey, this is Ben Glass. We’re out here in Prince William County at the Prince William Judicial Center where we’ve just finished a trial today. We’ve represented a motorcyclist who was pretty seriously injured when another car pulled out in front of him really just down the road around the corner from here, causing a serious personal injury.
GEICO had settled part of the claim but they wanted to dispute liability, and so we had a trial today. GEICO was trying to blame everything on the motorcyclist, or at least in part. And so, we collected the witnesses, we did our investigation, we brought them in. GEICO had a couple of witnesses and at the end of the day, the judge awarded us the full amount that we had asked for and she awarded full prejudgment interest, meaning that our client was compensated not only for the damages but for the time that GEICO had been holding this money.
Now our position, our view on the case was that GEICO’s position really made no sense at all in this Virginia personal injury case, and I think that the judge ultimately understood this. I think that their insured was making up some facts about the accident and the independent witnesses were great. So the teaching point here is just because an insurance company says “no”, as GEICO did early on in this case.
They said, “No, we’re not going to pay you,” get an experienced, board-certified personal injury attorney to consult with you and typically we’ll do this for free as will most other personal injury attorneys to look at all the facts, to do the investigation, to hire investigators, to talk to witnesses so that you can see if you have a chance to win your case. And then you hire an experienced, board-certified Virginia personal injury attorney to go and try your case as we did here today getting justice for our client.
