
Hey everyone this is Ben and it's a weekend and I was catching up on some of my reading and some of the news. And I want to talk to you today about what has to be one of the dumbest law suits ever filed in America. I'm sure you've heard of it, it's a lawsuit that this lady in California filed against the McDonalds corporation alleging that they're engaging in deceptive practices and misleading advertise and all sorts of stuff because they induce kids to come into the restaurant with happy meals.
This is unbelievable.
You probably have heard of this on the news but you probably haven't read the actual lawsuit. We've now got a copy of it over at BenGlassLaw.com, but let me tell you a little bit about this and then I've got some advice for this lady. Her name is Monet Parham and the lawsuit filed in California against McDonalds. And Miss Parham claims that McDonalds exploits very young California children and harms their health by advertising unhealthy happy meals.
And what she says is that children eight years of age and younger do not have the cognitive skills and the developmental maturity to understand the persuasive intent of the marketing. No kidding, that's why there's parents. And Miss Parham goes on to say that this advertising bates children to get into the stores and violates California law because it's inherently deceptive and unfair. Here's what's really interesting, she tells a story of her own family. Apparently, she's got daughters, ages two and six. And they continually clamor to be taken to McDonalds for the toys.
Look I've got nine kids, I know how hard it is sometimes to raise them right, to keep them safe, to get them to eat healthy foods. Yes indeed, I know how hard it is sometimes to keep them from McDonalds but we go to McDonalds. And I've got news for you; it's only going to get harder as they get older. Anyway, she goes on to say that often her daughters, two and six, want happy meals because the toys are based on trusted characters from TV and movies such as Shrek. Shrek is a trusted character to these children and her kids have been induced to want a happy meal because of toys like Barbie lip gloss and a small comb, of course, this Shrek movie action figures and an American idol toy. She says, shocker, when given the choice Parham's daughters want to eat happy meals instead of fruits, vegetables and whole grains. I've got news for you, she is just described most every child in the country. Look, this lawsuit like many class action lawsuits is really stupid. It causes McDonalds and other corporations defending these silly lawsuits to use their capital to pay lawyers and to deal with people like this. This lady needs to understand how to parent better.
Yes, parenting can be tough. When your kids are teenagers it's going to be a lot tougher. Who are you going to sue? When they are adults, they will probably look back at this lawsuit and be embarrassed for you mom.
