Virginia Supreme Court awards attorney fees in highly disputed long-term disability case.


The Virginia Supreme Court ruled in favor of the plaintiff who aimed to recover his attorney's fees in a hotly disputed long-term disability case. The disability case had already been found in favor of the plaintiff, with only the attorney's fees now in dispute.

In a couple of disputed points, the court noted the following:

‘Block billing’ is the time-keeping method by which each lawyer and legal assistant enters the total daily time spent working on a case, rather than itemizing the time expended on specific tasks.”

"After review of the Motion for Attorney’s Fees, the submissions of the parties, and the record in this case, the Court finds that the total requested lodestar amount of $409,847.75 (inclusive of the fee motion, the reply and all voluntary write-offs) reflects reasonable hourly rates and an amount of hours supported by the evidence and reasonably expended. The Court does not find that this is a “rare and exceptional case” warranting adjustment of the lodestar using a 'multiplier.'"
