Will the insurance company spy on me in my case?

One of the most common questions we see from new clients in personal injury or medical malpractice claims is “will the insurance company spy on me?”.

The Hartford does it a lot and a lot of the car insurance companies will do it in a serious case once your lawsuit has been filed. They’re out looking for that one slip up that would show your personal injury or medical malpractice claim is false! So how can you avoid having your case destroyed by your insurance company spying with video surveillance?

That’s pretty easy to answer, considering you just have to make sure that you’re honest with the extent of your activity level. If you don’t and they catch you lifting something you “can’t” then you just ended your own case!

See the people who have their cases destroyed by video surveillance tend to be the people who are exaggerating what they can and can’t do, or who are out right lying about their activity level and the extent of their injury. So, that’s really rule number one and probably all of the rules.

Just for example, if you’re sent questionnaires from Harford or Prudential, then the odds are that they’re attempting video surveillance with you. They want to CRUSH your case, and leave you empty handed!

You can bet your pants they’re going to be comparing their video footage with your activities list up and down. If any one of these insurance companies wants to do a field visit and sit down with you, odds are they already have you on video! Don’t let your actions contradict your abilities – this is an automatic loss in your claim, mainly because it’s a misrepresentation of your actual activity level.

As with everything you should discuss this with your own attorney, get his or her advice on how to best handle your own crime(ph).
