Virginia’s workers’ compensation was created in 1919 to act as a compromising system between the employers and the employees. It aims to help an injured employee though it does not pay the worker the same amount as his regular pay. Before workers’ compensation, it was difficult for an injured employee to claim any benefits because he had to prove that he was working in an unsafe environment. Nevertheless, it was really hard on the employee’s part due to the tedious litigation and investigation processes. Moreover, they had to spend a lot of money to pay for the litigation.
Today, because of the workers’ compensation, the injured employee can now receive his benefits, such as a part of his wages and payment for medical treatment, quickly and almost effortlessly. They do not have to provide evidence anymore that their employer was negligent in providing them with a safe working environment. However, the downside of this agreement is that compensation for suffering and pain cannot be applied for by the employee. It is not possible for employees to receive a large amount of money outright for expenses incurred by immediate medical attention and part of their supposedly wages.
It may seem like a fair deal for both the workers and the employers but as the years go by, many insurance companies and big corporations have appealed to the Virginia State Legislature and different exceptions were raised – most of which favour the employer.
Workers’ compensation does not cover all accidents that happen during and at work. The problem is when unfortunate mishaps occur in the work place, the employee will not be able to work plus they have to go against big insurance companies and big businesses that spend a lot of money annually just to have the selfish amendments they wanted to the workers’ compensation law which can actually deprive the employees their rightful benefits.
To add salt to the injury, dealing with most insurance companies can be long and tiring. They are trained to delay and if you do not play your cards right, they may even favour the employer resulting to more emotional damage.
The Virginia’s Workers’ Compensation Commission handles workers’ compensation in Virginia – not by those clever insurance companies.
