I made a huge mistake today in my long-term disability insurance claim and I guess I'm just looking for reassurance at this point. I experience severe cognitive problems/brain fog in addition to physical symptoms and at times the simplest tasks are very difficult for me. Anyway, it took me weeks to feel well enough to fill out a simple supplemental claim form for the LTD Company. Today I filled out the form and also prepared a fax cover sheet to my doctor so I could send him a copy of what I was sending to the LTD Company for his files. Well, I managed to send the fax addressed to my doctor to the LTD by mistake Since this is a new doctor, I included a message to the doctor noting that I have an attorney who specializes in LTD review most information that is submitted and advised him not to submit anything if requested until the attorney gets a chance to review it. I also noted that I have not had any problems with my benefits but want to continue having forms reviewed as a safeguard. Up until now, the LTD Company had no idea that an attorney was involved. Do you think anything will come of this? Will this be a red flag to the insurance company to investigate me further or more intensely? I am genuinely not capable of working or doing much else and the stress of always worrying about my benefits certainly does not help matters.

Do state statutes of limitation apply to Federal lawsuits of denial of disability benefits under ERISA?

I just starting receiving long term disability (LTD) payments and the bank wants to take the money that was just put into my account from the LTD carrier to pay a charged-off loan that I had with that bank. This happens to be my first payment and I didn't realize that the LTD carrier would be sending this money to my old checking acct. Does anyone know if this is legal? They have not taken the money yet, but they are threatening to and it is not in my hands yet.

I have been walking around in shock about the phone call I received the other day. I have a new disability claim reviewer. She told me that it was overlooked that I should have been getting 60% of my pay. I had been paid at the rate of 40%. Originally, they said that I became ill within a year of my coverage. Actually, my employer paid for this coverage for over 2 yrs., I upgraded and decided to pay into it, so if I became disabled that I would be able to collect 60%. I have been collecting LTD for four years now. I am shocked at the amount of the "underpayment" admission from Unum. $20,000. And, the amount of my monthly payment will be increased to $900. I was getting $400 plus my SS. I believe they have made a mistake. I am afraid they will come after me down the road and tell me that it was an error. However, meanwhile, I would love to get out of debt. They have included the amounts that I have been paid along with my SS payments listed. I thought the new amount may be accurate, but my SS will offset it. But, then that would not make sense, as my total was over $1,000 at 40%. I did apply for SS, the day after I resigned from my job due to disability. I was approved immediately. I reported it to Unum, and they adjusted my payments (reduced). I am very confused by this. I am a dummy when it comes to numbers. I am so scared they will come after me down the road and demand their money back. My husband tells me not to worry about it. I did ask the girl, if she was absolutely sure when she called me with info about Ununm's underpayment to me. I just have this feeling they will say it was an error. And, they will shut me off, and sue me for the error, down the road.
