I contacted Attorney Ben Glass's office and franticly spoke to his assistant Terry. We had a little more than two weeks to challenge my LTD provider's threat to offset my LTD disability payments by the amount of a recent settlement I had received on a Worker's Compensation claim - the claim was settled outside of the Worker's Compensation system.
The issue of access to the settlement funds was discussed in length with my Worker's Compensation attorney and it was determined that these funds would not be considered "income" as defined in my LTD policy therefore my LTD provider would not have any right to claim any portion of the settlement funds. The logic was excellent and I was very confident that the settlement could not be considered income as specified in my policy. However, the one thing I forgot (or subconsciously chose not to remember since from all of my experiences with my LTD provider I should have known better) is that the LTD Providers can do anything they want - then it's up to you to challenge their actions through the established appeals and/or court systems.
Terry was a pleasure to speak with and a pleasure to work with. Terry worked very professionally to outline all of the facts in my situation within a few days and present them to Attorney Ben Glass (I was pretty freaked out and just did a brain-dump on Terry - she reorganized my jumbled story so it actually made sense again). By Terry's attitude, her professionalism, her hard work, and her focus on helping the client, I knew that the culture in that office was very well developed. I also know that organizational cultures are generally developed and spread from the top down. I was already very comfortable with Attorney Ben Glass and I had not even spoken directly with him yet.
We knew from the start we were really asking for a miracle with a two+ week deadline. Not surprisingly, Attorney Ben Glass was booked solid straight through the deadline. Against all odds, Ben Glass delivered the miracle! Attorney Ben Glass got out of bed at the crack of dawn, using his personal time at home, to review all of the facts in my case including my policy and settlement details and develop an initial strategy to respond to my LTD Provider's demands. As I suspected, Ben Glass is completely focused on helping his clients if at all possible - and even sometimes when it should have been impossible!
The next day Ben Glass presented his findings. He immediately impressed us as someone who plainly knows the law, knows what to expect when dealing with an LTD provider, and was up front about the possible outcomes at each step. He did not make any empty promises of success nor ask for a huge fee. He laid out what will probably happen next, what my options were in response to my LTD Provider's demands, the risks in the case, and what it would cost for him to represent us through all the potential steps in the case lifecycle. His fairness and obvious integrity in all of this astonished us. Then he asked if we wanted to move forward with his office representing us or seek out another attorney. We were already so impressed with the help and relatively instantaneous turnaround Ben Glass's office had already provided us that we certainly had no interest in looking any further. If Ben Glass would represent us, that is who we wanted as our attorney!
Ben Glass agreed to represent us in this current issue with my LTD provider (I say "current issue" because for the past two years every 3-4 months there has been one issue after another with my LTD provider). Ben suggested I put a check in the mail for the agreed retainer amount and, since there is so little time left before the deadline, we should immediately put the plan of action into effect. Wow! Attorney Ben Glass was suggesting we get to work on the case before he received a payment from us. Not only is Ben Glass and his staff completely focused on helping the client; he is not driven by money; his drive is to help people - something rarely seen these days.
For the first time we were moving forward in response to an issue with my LTD provider without that overwhelming feeling of being defenseless. We now had someone on "our" side that knew their way around the LTD system and knew it well. The plan of action Ben Glass developed included having me provide the settlement paperwork my LTD provider was demanding. I was to include a cover letter with very short and specific wording. I sent this express mail on June 1st, in compliance with the specified deadline.
Meanwhile, Ben Glass was sending demands for information to my LTD provider. These demands were sent out June 2nd. When we received copies of the letters and demands Ben Glass sent to my LTD provider it even scared us! Both of us read it in amazement and jokingly commented that if we were the LTD provider we would read that list of demands and just surrender! The funny thing is, about 10 days later, Ben Glass called me to advise me that my LTD provider had decided not to offset my disability claim. They no longer were pursuing any measures to collect any funds out of my Worker's Compensation settlement. They all of the sudden agree that the settlement cannot be considered income as income is defined in my LTD policy!
Attorney Ben Glass sent us a copy of the letter from my LTD provider advising him, as my attorney, that they were abandoning their claim that my Worker's Compensation settlement was income as defined in my LTD policy. The letter was dated June 7th.
This means that: Faced with an already overloaded schedule, Ben Glass would not (or could not) leave us alone to fend for ourselves against a giant, intimidating, and harassing insurance company. Approximately 10 days after contacting Attorney Ben Glass's office Ben Glass, against all odds, had an action plan on how to initially deal with my case. One week after Ben Glass took our case our LTD provider amazingly backed off and reversed their position. We went from a very serious situation with a two week deadline back to normal life - not even needing an attorney. If and when we need an attorney for any area of law Ben Glass we would immediately contact his office. After this experience we would not want anyone except Ben Glass to represent us. Ben Glass's honesty and integrity is unparalleled. These attributes are hard to find these days and have worked to build a client-focused culture in his office making it a pleasure to work with Ben Glass and his staff. Attorney Ben Glass and his staff are completely focused on helping people. Of course he expects to be paid his due share but his pricing is fair especially considering his extremely talented knowledge and skills in the areas of law he practices. When I came to Ben for help, I had already appealed to Aetna three times for short-term disability. I was denied each time even though I had provided all information requested and then some. Ben reviewed my situation and felt we had a good case, so we proceeded. Shortly thereafter Aetna settled and said I should have no problem receiving long-term disability. Then, with Ben’s help, I applied for long-term disability and it started all over again. They denied the initial application, so we appealed. I actually have had the medical misfortune causing me to be a “frequent filer” with Ben & his highly competent staff. Two unlikely medical mishaps-one in 2005, the other two years later, both life-altering. With the 1st one, once I was out of the woods, a friend of a friend recommended a personal injury attorney, (Not Ben Glass) and I signed with him. In VA you only have two years to file from the date of injury, and just before that date, this lawyer decided to leave the practice he was in, strike out on his own…. I had to “re-sign” with him, and told my mom I was having second thoughts. Now I AM telling you, CALL BEN GLASS.” She had read his name in the paper on several occasions, this one in particular was an article reported in the Washington Post about a difficult case involving an HMO, which I was a member of. At first, I said we don't need a lawyer. Believe me, we did. Ben was patient and kind and although the truck driver was at fault, we were never offered a penny until less than a week before trial date 2 years and 9 months later. (My medical bills were over $150,000.)
The first small offer was weeks after the only professional witness on their side stated in an independent exam that all my medical care was due to this accident. They never denied fault. Although my life has been dramatically affected, I found many injuries are hard to prove medically. The insurance company lawyers dug into absolutely everything in my past, affected my relationships with my personal physicians, and tried to make me feel like my life didn't matter.They were like little rats who latched on and wouldn't let go. I know I deserved more than what we got in settlement, and I still live every day with pain and limitations. I still pay several thousand dollars out of pocket yearly when I decide to once again try to find solutions to my pain.
My career I worked so hard for was destroyed. We were offered a somewhat decent settlement and I did not want to go to trial, so we settled our case. We had no way of knowing what a Northern Virginia jury would decide and Ben helped us to be realists. You can not depend upon your doctors to save your case because they don't like this kind of stuff. We knew from the beginning to not expect a very high settlement even though it was one of the most severe type of accidents that could happen.
I was fortunate to live through it and still be able to lead a somewhat decent life. There are nights I still can't sleep and sob for the pain, when I have doubts about accepting the settlement, but I have seen what the insurance company lawyers can do, and believe me, you do need a lawyer. I am writing today to tell you how much your last book and your philosphies have helped me.... You actually got me through some tough times over the last few months, and continue to do so today (and probably tomorrow and on and on). you see, at the age of 50 i had a heart attack, followed by hospitalizations, followed by erroneous release from the hospital, followed by readmittance, following by a double bypass, followed by my first (of several, evidently) lung sack drainage procedures which involves much courage and a long needle in the back. you may not believe this, but all this has not been nearly as fun as it sounds.

I needed to sleep and mend! ... so my version of not answering the phone and being less accessible was to keep the door closed and not answer the phone! i continue to not answer the phone at home. it drives visitors crazy, but why should i stop what i am doing for a phone call when i have an answering system? it is so logical. i wonder why we are all slaves to the phone.
also, i only hung with the positive patients... the ones that were much further along in their recovery than i was. it really worked. who wants to hang with a bunch of sick people, anyway? i later learned they had gone through a much lessor surgery than i had.... and here i thought they were just real troopers. oh well! worked for me! Well, i certainly don't want to be a time thief, so i'll close. i just wanted you to know that attorneys and entrepreneurs aren't the only ones who can catch on to your terrific advice.
